ATHENS, Ala – This year marks the 32nd year of the Athens Christmas Open House.  Each year, Christmas Open House kicks off the holiday shopping season. In addition to traditional Christmas Open House activities, there will be a number of Bicentennial celebrations also taking place during the weekend.  Athens turns 200 years old!  One such activity will be the recreation of the historic Trade Day photo from the 1900’s. The large crowd captured in this photo was assembled for a car give-a-way. On Saturday at 2 p.m., a photographer will take a photo of the crowd onMarion Street to recreate this historic photo.  With the help of a generous donation from Dealers Auto Auction of a gently used Kia Rio to be given away by Athens Main Street, the crowd promises to rival the historic photo!

For a donation of $5/1 ticket or $10/3 tickets to Athens Main Street, adults age 19 and older will be entered for a chance to participate in the Bicentennial Trivia Contest. The trivia contest will take place on Saturday at 3 p.m. at the Courthouse Steps (Marion Street).  Five tickets will be drawn to participate in the trivia contest.  The winner of the trivia contest wins the car.  Donation tickets can be purchased at Athens State University Center for Lifelong Learning Friday evening, November 16th from 4 p.m. – 8 p.m. and Saturday morning November 17th from 10 a.m. – 2:30 p.m. of Christmas Open House. 

OFFICIAL RULES FOR ATHENS MAIN STREET BICENTENNIAL CONTEST

Void outside the 50 United States, District of Columbia and where prohibited. Must be at least 19 years of age and a legal resident of, and located within, one of the 50 United States or the District of Columbia, at the time of entry. Must have a valid driver’s license of the United States of America, or the District of Columbia, at the time of entry.  By participating, you agree to be bound by these Official Rules and the decisions of the Sponsor, which are binding and final in all matters relating to this Contest.

The Athens Main Street Bicentennial Contest (the “Contest”) begins at 8:00 a.m. Central Time (“CT”) on 11/12/18 and ends at a time designated by the Athens Main Street Executive Director (the “Director”) on 11/17/18 (the “Contest Period”).

SPONSOR: Athens Main Street (“Sponsor”).

HOW TO ENTER: During the Contest Period, visit the Athens State University Center for Life Long Learning from 4:00-8:00 PM on November 16, 2018, or from10:00-2:30 PM on November 17, 2018, complete the required information (name, address, etc.) on the entry form and buy a ticket for $5 (or three for $10).  Entries by mail will not be accepted. Entry forms that do not include all required information or that include ineligible information will be void. All entries must be submitted by a time designated by the Director on 11/17/18 to be eligible. All entries become the property ofSponsor and will not be returned.

LIMIT: There is no limit per entry per person.   

INELIGIBILITY: Employees and members of the Board of Directors of Athens Main Street, and their immediate family members (regardless of where they reside) or household members, whether or not related, are not eligible to enter or win. “Immediate family members” shall mean spouses, parents, step-parents, children, step-children, siblings, step-siblings, and their respective spouses. “Household members” shall mean people who share the same residence at least three months a year.

WINNER SELECTION/DRAWING: On 11/17/18, at a time to be determined by the Director, on the Athens Square, (a) Sponsor will conduct a random drawing from among all eligible entries received throughout the Contest Period to select five to ten finalists(the “Finalists”); (b) the Finalists will then compete in a game of trivia in which they will be required by the Sponsor to correctly answer questions related to the history of Athens (the “Game”); and (c) the Finalist that answers the most questions correctly in the Game (of the number that is determined to be asked of the Finalists by the Director) will be the winner(the “Winner”).  (A Finalist cannot be the Winner unless he or she gets at least one trivia question in the Game correct.)  Contestants must be present for all phases of (a)-(c) to become the Winner.

WINNER NOTIFICATION: The Winner will be notified when he/she is announced by the Director in person on the Athens Square at the completion of the Game.  The Winner will be required to complete and return an Affidavit of Eligibility (a copy of which is available upon request), the IRS W-9 Form, and a photocopy of a valid state issued Driver’s License within five (5) days of date of notification or an alternate winner may be selected via a second trivia competition (in the same manner as the Contest) from among all the other Finalists. If such documents are not returned within the specified time period, or potential winner is not in compliance with these Official Rules, the prize will be forfeited and, atSponsor’s discretion, an alternate winner may be selected as stated above. 

PRIZE[1]: The prize is one used 2009 Kia Rio, VIN # KNADE223196575768(the “Prize”). Sponsor will coordinate delivery of the Prize with Winner, andSponsor reserves the right to hold the Winner responsible for the costs of delivery. Once the Prize is delivered, the Contest is over. The Prize is awarded “as is” with no warranty or guarantee, either express or implied, whatsoever by Sponsor. SPONSOR IS CLAIMS, WITH RESPECT TO THE PRIZE, ALL WARRANTIES, EXPRESS OR IMPLIED,INCLUDING, WITHOUT LIMITATION, ALL IMPLIED WARRANTIES OF MERCHANT LIABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Winner may not substitute, assign or transfer Prize or redeem the Prize for cash. Winner is solely responsible for all applicable federal, state and local taxes, insurance and all other costs and expenses associated with prize acceptance and use not specified herein as being provided.  The awarding of any Prize (or portion thereof)is contingent upon full compliance with these Official Rules. All prize details are at Sponsor’s sole discretion.

ARBITRATION: Except where prohibited by law, as a condition of participating in this Contest, you agree that:  (1) any and all disputes, claims, and causes of action arising out of or connected with this Contest, or the Prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration conducted by an arbitrator selected by you and the Sponsor, or failing any selection after a reasonable period, by a Circuit Court judge ofLimestone County, Alabama; and (2) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim punitive, incidental or consequential damages including, without limitation, attorney’s fees or any other damages, other than for your actual out-of-pocket expenses (i.e., costs associated with participating in this Contest), and you further waive all rights to have damages multiplied or increased.  This Contest is governed by the laws of theState of Alabama.

RELEASES: By participating in this Contest, you agree to release the Spirit of Athens, Inc.(d/b/a Athens Main Street), the City of Athens, Alabama, and any other organizations affiliated with the sponsorship, fulfillment, administration, prize support, advertisement or promotion of the Contest and each of their respective parents, agents, affiliates, subsidiaries, advertising and promotion agencies, and prize suppliers, and each of their respective officers, directors, managers, shareholders, members, agents, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the “Released Parties”) from any and all actions, claims, injury, death, loss or damage arising in any manner, in whole or in part, directly or indirectly, from participation in this Contest and/or acceptance, use or misuse of the Prize (or portion thereof), including, without limitation, the inherent risks associated with the use of the Prize.

OTHER: ReleasedParties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, undelivered, mutilated, ineligible, garbled or misdirected entries or registrations, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Prize, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing of entries, the announcement of the Prize, or in any Contest-related materials. Sponsor reserves the right, in its sole discretion, to disqualify any person tampering with the entry process or otherwise in violation of these Official Rules. Sponsor further reserves the right, in its sole discretion, to cancel, terminate or modify this Contest or any other causes which, in the sole discretion of the Sponsor, corrupt or affect the administration, security, fairness, proper play or integrity of the Contest.CAUTION: ANY ATTEMPT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OFTHIS CONTEST IS A VIOLATION OF THE LAW, AND SHOULD SUCH AN ATTEMPT BE MADE,SPONSOR WILL DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING, WITHOUT LIMITATION, ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING,WITHOUT LIMITATION, CRIMINAL PROSECUTION. 

Except where prohibited by law, entry constitutes permission to use your name, hometown (city and state), voice, biographical information, likeness, photograph and any statements regarding this Contest in all media now known or hereafter discovered, for any purpose, including, without limitation, in connection with, and to promote, market or advertise, the Contest, in whole or in part, without review, approval, credit or attribution, notification or payment from or to you or any person or entity, worldwide, in perpetuity, or on a winner’s list, if applicable. Contest is subject to all applicable U. S. federal, state and local laws and regulations. An IRS Form 1099 will be issued with respect to the Winner in the amount of the Prize as reasonably determined by the Sponsor and the Prize may be taxable as income.
